1. Introduction

These Terms of Service govern the sale of goods by Pennine Fabrics ("we", "our", "us") to our customers ("you", "your"). By placing an order with us, you agree to be bound by these terms.

2. Products

We make every effort to ensure that product descriptions, specifications, images, and colours are as accurate as possible. However, due to variations in screens, lighting, and manufacturing processes, colours and appearances may vary slightly from those shown.

Fabric compositions, widths, weights, and finishes are provided in good faith but may be subject to reasonable manufacturing tolerances.

3. Orders

All orders are subject to acceptance and availability.

We reserve the right to refuse or cancel any order at our discretion, including where pricing errors, stock discrepancies, or other inaccuracies have occurred.

Once an order has been confirmed and cut to the customer's requirements, it may not be cancelled.

4. Pricing and Payment

All prices are stated in Pounds Sterling (£) unless otherwise specified.

Prices may be subject to VAT and any other applicable taxes.

Payment must be received in full before goods are dispatched unless otherwise agreed in writing.

5. Delivery

Delivery times provided are estimates only and are not guaranteed.

Risk in the goods passes to you upon delivery. Ownership of the goods remains with Pennine Fabrics until full payment has been received.

Customers are responsible for ensuring that delivery details are accurate at the time of ordering.

6. Inspection of Goods

Customers should inspect goods upon receipt and notify us promptly of any shortages, damage, defects, or discrepancies.

No fabric should be cut, altered, processed, or manufactured into finished products until it has been fully inspected and approved by the customer.

Pennine Fabrics cannot accept liability for claims relating to fabric that has been cut, processed, or otherwise used.

7. Returns and Refunds

Please refer to our Returns Policy for full details.

As most orders are cut specifically to customer requirements, we are unable to accept returns of cut fabric except where goods are faulty or supplied incorrectly.

Any return accepted at our discretion may be subject to a re-stocking fee due to most fabrics being cut to the individual customer requirements.

8. Limitation of Liability

Our liability for any claim relating to goods supplied shall not exceed the purchase price of those goods.

We shall not be liable for any indirect, consequential, or economic losses, including loss of profits, loss of business, production delays, or third-party claims arising from the use of our products.

9. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, industrial disputes, transportation disruptions, supplier failures, or governmental actions.

10. Intellectual Property

All content on our website, including text, images, logos, graphics, and product information, remains the property of Pennine Fabrics unless otherwise stated and may not be reproduced without permission.

11. Privacy

Any personal information collected by us will be handled in accordance with our Privacy Policy and applicable data protection legislation.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
